Jason Hirschel provides strategic counsel to clients across a broad range of complex legal, business affairs, and compliance matters, with an emphasis on digital media and marketing, risk analysis, dramatic rights licensing, trademarks, employment, book publishing, pre-litigation dispute resolution, and general corporate governance. His practice includes the representation of individuals and businesses, with a focus on start-ups, ad networks, advertisers, publishers, affiliate networks, affiliate marketers, and lead generators. Jason’s counsel combines years of transactional experience as in-house counsel with a detailed knowledge of Internet-based marketing best practices; data protection regulations, including CCPA and GDPR; and direct response marketing and advertising laws, including CAN-SPAM and FTC marketing regulations. Accordingly, Jason specializes in providing cost-effective guidance and creative solutions for clients looking for the best ways to responsibly build their brand, minimize risk, and protect their commercial interests without stifling growth.
Before joining the firm, Jason served as Executive Vice President & General Counsel at Flex Marketing Group, LLC, where he directed all in-house legal matters. In addition to drafting, reviewing, and negotiating all digital media, advertising, affiliate, data, hosting, IP, revenue sharing, joint venture, technology and content licensing, data collection and list management, and employment agreements, Jason provided subject matter expertise on a wide array of business affairs and compliance matters, including corporate formation; content creation, clearance, and deployment via e-mail, paid search, and display channels; and website terms and conditions and privacy policies.
Jason received a Bachelor of Arts from the University of Michigan and a Juris Doctor from New York Law School. He was awarded the prize for best TV Writing Sample in the 2018-2019 Fresh Voices Screenplay Competition. He is admitted to the New York State Bar.
